TENNESSEE VACATION RENTAL AGREEMENT



Barefoot Vacation Rentals LLC & Hidden Paradise Farms LLC

(Intended for occupancy of 30 days or less) By occupying/ visiting the property, you accept all of the following terms and conditions:

ONLINE RESERVATIONS

All reservations are not guaranteed until confirmed by Management. A confirmation email containing "Arrival Info" will be sent within 24 hours of online booking. Online rates are subject to change until confirmed with Management. By booking, you agree to ALL terms and conditions, including charging the credit card on file with/without a written signature.

PROPERTY

Occupant rents, for vacation purposes only, the furnished real property and improvements described in the booking confirmation.

  3.  AUTHORIZED USE AND GUESTS: The Premises are for the sole use as a personal vacation residence by  and Guests . is responsible for any and all guests that use the property during the term of this agreement. Authorized Guests may not exceed the total allowable Guests for Property at any time. No other guests, visitors, or persons are permitted unless discussed and approved by management and appropriate fees have been paid. If the Premises are used, in any way, by more or different persons than those identified in this paragraph, 

    (i) Occupant, Authorized Guests, and all others may be required to immediately leave the Premises or be removed from the Premises; 

    (ii) The occupant is in breach of this Agreement; and 

    (iii) Occupant forfeits its right to return of any monies collected.

ARRIVAL & DEPARTURE

  • Check-in: No earlier than 4:00 PM on arrival date.

  • Check-out: No later than 11:00 AM on departure date.
    Failure to vacate within 15 minutes of scheduled departure may result in a minimum $25 fine. Staying beyond one hour after scheduled departure will result in an additional night's charge.

AUTHORIZED USE & GUESTS

The premises are for the sole use of the registered guest and their approved guests. No additional guests are permitted without prior approval from Management. Unauthorized guests may result in immediate removal without refund.

PAYMENTS & CANCELLATION POLICY

  • 50% due at booking (non-refundable).

  • Balance due 30 days before arrival (non-refundable).

  • If booking within 30 days of arrival, 100% is due at booking.

  • Security deposit: $250 due 7 days before arrival or purchase of a Vacation Rental Damage Protection Plan.

    • SECURITY DEPOSIT/ DAMAGE PROTECTION:  Barefoot Vacation Rentals requires a damage deposit for all VRBO or Direct book guests. There are two options the $250 refundable deposit or a Vacation Rental Damage Protection Plan:

      • A separate refundable damage deposit of $250 will be automatically drafted 7 days prior to check-in. It will be automatically released 7 days after check-out, provided no damages or additional charges apply.
      • The Vacation Rental Damage Protection plan is activated through Generali Global Assistance. As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided, they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3,000. Any damages that exceed $3,000 or are not covered under the plan will be charged to the credit card on file. If during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy www.vacationrentalinsurance.com/g20vrd. The Vacation Rental Damage plan can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance and Insurance Services to pay directly Barefoot Vacation Rentals, LLC any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact Barefoot Vacation Rentals, LLC directly if you do not wish to participate.

        Security Deposit Option: (Choose one)

  • All payments are non-refundable unless the property can be re-booked. A 10% cancellation fee will apply if a replacement booking is found.

FARM & PROPERTY LIABILITY WAIVER

By occupying/visiting the property, guests acknowledge and assume all risks associated with farm activities, including but not limited to:

  • Interaction with farm animals (risk of bites, scratches, allergic reactions, etc.)

  • Uneven terrain, fencing, and other natural or man-made obstacles

  • Weather-related hazards (mud, flooding, slippery surfaces, etc.)

  • Use of equipment or structures on the farm property

Guests agree to hold harmless the property owners, managers, employees, and affiliates from any claims, injuries, damages, or losses sustained while on the property. Guests enter and participate in farm activities at their own risk.

NOISE & QUIET HOURS

  • Quiet hours: 10:00 PM - 7:00 AM.

  • Excessive noise fines: $100 per occurrence.

  • If management or security must intervene, a $300 fee will apply. If law enforcement is called due to noise complaints, the reservation will be canceled, and guests will be required to vacate immediately without a refund.

PARKING

Guests must adhere to designated parking areas.

CLEANING & DAMAGES

  • A mandatory, non-refundable cleaning fee will be applied to all reservations.

  • Guests are responsible for any damage beyond normal wear and tear. If damage exceeds the security deposit or damage protection coverage, additional charges will apply.

  • Any missing items, excessive cleaning, or unauthorized alterations to the property will result in additional fees.

PET POLICY

  • Pets are not permitted unless approved by management and the appropriate fee is paid.

    • Pet fees are additional fee of $30 per pet, per night, plus a $70 non-refundable damage deposit.
    • Limit 2 dogs. Must be on leash and get along with other animals as this is a working farm.
  • Unauthorized pets will result in a $150 fine, plus additional cleaning fees.

  • Guests are responsible for any and all damage or injuries caused by their pets.

SMOKING, DRUGS, & ALCOHOL

  • Smoking (including vaping, marijuana, and cigarettes) is prohibited on the premises. A $200 cleaning fee will apply if violated.

  • Illegal drug use is strictly prohibited and will result in immediate eviction without a refund.

  • Alcohol consumption must comply with Tennessee state laws. No underage drinking is permitted.

USE OF AMENITIES (FISHING, FIRE PIT, ETC.)

  • Use at your own risk.

  • Guests agree to indemnify and hold the property owners harmless for any injuries related to the use of amenities.

PROPERTY MAINTENANCE & RIGHT TO ENTER

Management reserves the right to enter the premises at any time for maintenance, inspections, or emergencies.

NO ASSIGNMENT OR SUBLETTING

Guests may not sublet or assign the rental agreement. Violation will result in immediate termination of the reservation without a refund.

MISCELLANEOUS

  • Fireworks, and explosives are prohibited on the property.

  • Guests must report any property damage or safety hazards immediately.

  • The property may not be used for commercial purposes, including filming, events, or parties without prior approval and additional fees.

MEDIATION

Occupant agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved.

RELEASE

In consideration of the right to occupy/visit the home, I hereby release to the fullest extent allowed by law, the Owner and its Management, members, officers, associates, employees, agents, representatives, attorneys, assigns, and affiliates (collectively, the "Affiliates") from all liability or responsibility of any kind whatsoever for any personal injury, death, property damage or other loss sustained by me, my minor children, any guest identified on this form, or any guest or person allowed onto the property during my rental dates as a result of my, my children's or the guest's participation in a visit to the home, due to any cause whatsoever, including without limitation negligence on the part of Owner or Management. I understand that this release will bind my heirs, administrators, executors, and any other person or entity seeking to claim under or through me. 

 

AGREEMENT ACKNOWLEDGEMENT

By booking and occupying the property, the guest acknowledges and agrees to all terms outlined in this agreement. The Hidden Paradise Farms, LLC & Barefoot Vacation Rentals LLC is released from any liability related to personal injury, property damage, or farm-related risks.
